The Hallowed Walls of The American Writers Museum

The Hallowed Walls of The American Writers Museum Early in February I finally got to go the American Writers Museum here in Chicago. I saw that Ross Gay was reading from his new essay collection The Book of Delights and took the reading as the nudge I needed to see this museum finally. My excuses for not visiting were not great: Yes, I had just finished graduate school right before it opened for business; Yes, I was currently living an hour a way and looking for work; but that was two years ago, and the thought just slipped through my brain. When I walked up the short flight of marble stairs, past the doorman and the teeming traffic below, I was sad that I had not visited sooner. This unassuming museum isn’t very big; it only takes up one floor of a building where Lake Street and Michigan Avenue meet, yet it makes up for with ambition and scope. It is also inexpensive and the swag is great. Admission is 12 bucks, and there were free bookmarks to geek out over when I first came in the door. First, I saw the wall where Chicago Writers stood proudly on their banners. Some of the people who have shaped the way I think like Saul Alinsky, Studs Terkel, and Nelson Algren smirked at me through their photographs as I reached out and traced their names. As I walked around, there were also screens of magnetic poetry glowing up for visitors to move around. It reminded me of a teacher I knew once who told me that my exposure to words was as essential for me to grow up and become a reader. As I wandered through, kids plunked away at typewriters, visitors could vote on their favorite books on big screens, and there were also visiting exhibit on Fredrick Douglass and Bob Dylan. Above my head, brightly colored books lined the ceiling. My favorite exhibit, though, was the Nation of Writers. It was a long, skinny passageway with spinning panels and pictures that opened up to reveal things about the authors inside. Here my friend and I went through chatting about what we have read and what we still need to add to the list. In the Nation of Writers, I was pleased to see some of the heavy hitters like Maya Angelou, Mark Twain, and Abigail Adams, but also those who we do not learn or teach as often as we should, such as Margret Fuller or MFK Fisher. My biggest critique of this little museum is that there are shockingly few books. As I wrote this, I teetered back and forth on whether or not this bothered me. On the one hand, I think it is crucial to pay homage to the physical paper, ink and glue that kept the words of these writers besides us. On the other I was so enchanted by the way this museum was so darn accessible. Everything within its wall was touchable, and interactive, it felt graceful, smart, and welcoming. Somehow it felt sacred but never stuffy. It is both a place made out of clouds from English major heaven and a gateway for those who have barely begun to grasp the joy and legacy of American Letters.

In 1908 Herbert Asquith, replaced Cambell Bannerman as prime minister, Asquith was against women’s suffrage. This change caused the WSPU to intensify their militant methods they broke windows and threw stones. Mrs Fawcett, who had once praised the movement for the advancements it made to the suffrage cause, condemned these violent methods. Causing the WSPU to become further alienated. In 1909 as the arrests for these and such offence increased the WSPU campaigners who were imprisoned began to go on hunger strike, after a few months the prisons began force-feeding the women. This was a very dangerous process involving a 4 ft. long tube being forced down the woman’s throat. In 1910 the WSPU together with NUWSS persuaded the government to set up a conciliation committee and introduce a bill for women’s suffrage. Mrs Pankhurst called off all militant action, hoping this bill would finally bring an end to the struggle and give women the vote. The bill passed its second reading on the 12th of July, despite some opposition from Liberal Party MPs. The bill however progressed no further, Asquith declared there was no more time to spend on the bill and suspended parliament until November. On the 18th of November the WSPU called off the truce, over 400 women went to the House of Commons to protest. Necessary Physical Contant in D.H. Lawrences Women in Love and Platos Symposium D.H. Lawrence’s novel, Women in Love, presents a complex model of female-male and male-male relationships. Lawrence is stating that the body functions much like the soul in Plato’s philosophy in that both are â€Å"mystic.† Lawrence’s description of bodily exchange being â€Å"mystically-physically satisfying† conveys that both the mind and body are inextricably linked: the body is needed to establish a mental connection. That mental connection is explained when Ursula describes to Hermione that Birkin â€Å"wants [her] to accept him non-emotionally,† and, â€Å"He wants [her] to accept him as †¦ an absolute (333). string(67) " reasonably have been expected to know, that B had the disability\." ‘The prohibition of discrimination arising from disability in the Equality Act 2010 s.15 has, to a great extent, rectified the damage done to the protection of disable people by the House of Lords decision in Mayor and Burgesses of the London Borough of Lewisham (Appellants) v Malcolm [2008] UKHL 43’ Introduction This statement is true to an extent as s.15 of the 2010 Act was clearly intended to reverse the harsh effect of the decision in Malcolm which established that a requirement for less favourable treatment was necessary to founding a discrimination claim in respect of a disabled person[33]. The Equality Act 2010, of which the majority of provisions came into force in October 2010, is not flawless but does undo some of the damage done by Malcolm that favoured landlords and undermed indirect discrimination in respect of disability. S.15 does present some problems in respect of the knowledge of the employer in both direct and indirect discrimination cases and this will be discussed in part 2 which will follow a discussion of the decision in Malcolm in part 1. Part 1: The decision in Malcolm The facts of Malcolm were that a local authority (L) appealed against the dismissal, by the Court of Appeal, of its possession proceedings against the respondent (M) who had been diagnosed with Schizophrenia. M had become a secure tenant of L and before exercising his right to buy M had sublet the flat out and by virtue of the Housing Act 1985 s.93 he lost his secure tenancy. L then gave a notice to quit and initiated possession proceedings against M. It later emerged that M was not taking his medication for schizophrenia at the time of the subletting and crucially it appears that the local authority were completely unaware of M’s condition. This lack of knowledge was the catalyst for the judge to grant the possession proceedings and ultimately for the House of Lords to overturn the Court of Appeal which had dismissed the possession proceedings and allowed M’s appeal on the grounds that the notice to quit and the possession proceedings were unlawful discrimination under the Disability Discrimination Act 1995 s.22(3). The Court of Appeal further found that there was a sufficient causal relationship, despite the subjective lack of knowledge on the part of the Local Authority, when viewed objectively and consequently M was treated unfavourably[35]. The House of Lords appeal was based on two grounds as Orme opines and this part will look at the decision along these lines: â€Å"First, in order for the alleged discrimination to â€Å"relate to† the disability within s.24(1)(a), must the fact of the disability have played some motivating part in the mind of the alleged discriminator when subjecting the disabled person to the treatment complained ofSecondly, what is the correct comparator in order to determine whether the disabled person has been treated less favourably so as to have been subjected to discrimination?†[36] Their Lordships dismissed the objective causal link established by the Court of Appeal with Lord Scott observing that: â€Å"It was not enough for M to show that objectively viewed there may have been a causal connection unknown to the local authority between the sublet and M’s disability†[37]. Their Lordships found assent in the case of Taylor v OCS Group[38] where a deaf claimant was dismissed for misconduct after a disciplinary hearing and the Court of Appeal, in dismissing an appeal which tried to establish an objective link, argued that without a subconscious or conscious frame of mind there could be no question of discrimination. Orme points out the implications of this reasoning: â€Å"It follows that the alleged discriminator must have at least some imputed knowledge of the existence of the disability in order for it to form a part of the motivation for the decision to inflict the treatment.†[39] On the question of the comparator, which was a key question in determining whether a disabled person has been subjected to direct discrimination under the old Disability Discrimination Act 1995, the Court of Appeal insisted along the lines of the case in Novacold[40], that the correct comparator was in fact a person without schrizophrenia who has not sub-let their property as this â€Å"relates to† their disability. This tortured reasoning was dismissed by their Lordships with Lord Scott even commenting that the comparator used in Novacold which had inspired the Court of Appeal, was â€Å"pointless†. The typically used example from Novacold is the blind man with the dog who are refused entry into a shop[41] and the comparator extrapolated from this was that of a non-blind person with no dog. As Orme points out the reasoning behind using a comparator with like characteristics is to produce a more meaningful comparison and ultimately the House of Lords settled on: â€Å" the correct comparator was a person without schizophrenia who had sub-let without the consent of the landlord.†[42] But does this lead to an unfavourable situation against the claimantBamforth et al, writing before the Malcolm decision, thought that it would because of the difficulties of identifying a comparator in a similar situation albeit without the disability and a â€Å"add layers of complexity to the test†[43]. There were undoubtedly strong public policy reasons for the Malcolm decision but in denying any causal link and in changing the established comparator rule the decision was harsh towards potential disabled claimants. Part 2: The Equality Act 2010 and s.15 Section 15 of the 2010 Act provides: â€Å"(1) A person (A) discriminates against a disabled person (B) if— (a) A treats B unfavourably because of something arising in consequence of B’s disability, and (b) A cannot show that the treatment is a proportionate means of achieving a legitimate aim. (2) Subsection (1) does not apply if A shows that A did not know, and could not reasonably have been expected to know, that B had the disability. It should be pointed out that no knowledge on the part of the employer is required in respect to a s.19 claim for indirect discrimination[45] so there is in effect a recognition by Parliament that providing the knowledge defence in both situatio ns would have been too conciliatory to landlords. The aims of the Equality Act 2010 were clear as the Solicitor-General pointed out in Parliament: â€Å"The clause is intended to address the consequences of Lewisham v. Malcolm [[2008] UKHL 43], which frankly made it difficult for a disabled person to show that they had been subjected to disability-related less favourable treatment.†[46] Conclusion In conclusion the statement regarding Malcolm is mostly true in that by removing the comparator for people trying to prove disability related discrimination Parliament has removed a controversial element which divided many courts and put incredible burdens upon claimants undoubtedly to their detriment. However, in retaining the knowledge defence from Lewisham, Parliament has retained a part of the judgement which sent shockwaves through the legal community. The retention of this part will undoubtedly allow many to escape by claiming that they had no knowledge at all but perhaps this is better than trying to create links when none could exist. Petrified Man By Eudora Welty Petrified Man by Eudora Welty One of Eudora Welty's criticisms is that she occasionally possibly misrepresents the culture and influence of the south. Do you think that is the case in The Petrified Man? When I think of the south, I think of southern hospitality. I picture people always talking to each other, whether it's just small talk or gossip, which is the case in The Petrified Man. The dialogue itself appears to be pretty accurate (from what I can imagine anyway, since I've never been down south). The south definitely has a certain way of talking and Eudora Welty does a great job showing us, not just telling us, this dialect. From the very first sentence of the story, you know where you are, and the type of people involved in the story. "Reach in my purse and git me a cigarette without no powder in it if you kin, Mrs. Fletcher, honey ... I don't like no perfumed cigarettes." As for the events themselves, they appear to be reasonably honest. If you allow yourself to just listen to the story as it's being told, instead of trying to analyze it's validity (it is fiction after all) you will believe you're sitting in Leota's beauty parlor with Mrs. Fletcher and Leota talking about anything or anybody. It doesn't matter exactly what you're talking about, as long as it takes the attention away from your own lives, if just for an hour or two. Although some people might be offended at the gesture that all the women in the south sit around and just talk about everyone else, I think it's accurate. Not just in the south, and not just with women. For some reason, people find comfort in talking about other people's lives and forgetting about theirs for a little while. How do the major characters react to the story that Leota is telling? Do they change or learn anything? I know when I hear a story, I don't look for a moral to incorporate into my life. I just listen to the story and allow myself to be entertained. I believe that's the same with the characters in this story. I don't think they learned anything. Even at the very end of the story when Mrs. Pike's son, Billy Boy, runs out of the beauty parlor and yells "If you're so smart, why ain't you rich?" I don't think either Leota or Mrs. Fletcher even understood his point. I think Mrs. Fletcher did change however. At the beginning of the story it seemed that she was irate when she found out her pregnancy was the topic of discussion at the beauty parlor. "'Who was it?' demanded Mrs. Fletcher." By the end of the story, once they had talked about everything that had happened to Mrs. Pike and her husband, Mrs. Fletcher felt fine about talking about the pregnancy. "I guess I better learn how to spank little old bad boys," as if once the attention was on someone else, she no longer cared about people talking about her pregnancy. Now, in fact, she was talking about it. Do you think the on going theme of the story is? I thought the theme of the story was jealousy. I started thinking about it as soon as Mrs. Fletcher started getting defensive once Leota told her about Mrs. Pike. The more Leota talked about her, the more defensive Mrs. Fletcher got. "Does she know everything about you already?" Then all of the sudden, once she found out that Leota and Mrs. Pike had had a falling out, everything was fine. As mentioned before, when Mrs. Fletcher found out Mrs. Pike was the one that told Leota Mrs. Fletcher was pregnant, she was outraged. Mrs. Pike was the one Leota talked to all the time now. She was the one who heard all the stories about everyone in town. She was Leota's new confidant if you will. To prevent from slipping too far down on Leota's friend list, Mrs. Fletcher kept asking questions about Mrs. Pike pretending to be interested. The whole time just waiting for the time when she would mess up. Once she knew that their friendship was over, everything was great. She no longer cared about people talking about her pregnancy. As for Leota, her jealousy seems to be the only reason for her hatred of Mrs. Pike. Jealous of the fact that it was her magazine that Mrs. Pike had seen the reward poster in, jealous that
